The bathroom fan unit in our house vents into the attic. It has a "gooseneck" in it then is just attached along one of the roof joists. It is always filling with water from the condensation of the air removed from the bathroom and then it starts to drain back down into the bathroom.

Is this a bad fan or is it vented incorrectly?

It is vented incorrectly.
There are capped vents for these, and it should be vented through the roof or a wall.
The condensation, of course, is due to the warm, moist air from the bathroom hitting the cold vent pipe in the unheated attic.
You can wrap and duct tape insulation batts around the vent pipe to help prevent the condensation.
Install a roof vent and insulate the attic section of the exhaust hose, and it should solve your problem.
