We bought the Heat Pump in 2005. We have had problems with it from since we bought it, and now it isnt running at all. Sears wants to charge Labor to fix a Heat Pump that is Lemon and Carrier wont do anything to resolve the problem. If yall was in the same situation what would yall do?

Please list the set of problems you've had and approximate dates. Carrier is definitely on the hook for any manufacturing problems in the system, but can't really be held responsible for any installation related issues.

I would have to point out that Sears is only the middle man and on a unit that is four years old I'm not surprised they want to charge for any repairs.
What exactly is Carrier's repsonse to your problems and requests? :coffee:

Call the BBB. Youd be surprised how things get fixed right quick after that.

I agree that after this long you would do well to suck it up and call another company to service it.
Sears does not install these systems themselves and only contracts out the install.
It would make sense to get a company that can fix it properly.

And the companies they sub out to are not always the best around, but they are the cheapest.

Id call a company that is not associated with sears to fix it.
We called a Certified Tech to come out a diagnose it. He said it was a piece of "Junk".

Please list the set of problems you've had and approximate dates. Carrier is definitely on the hook for any manufacturing problems in the system, but can't really be held responsible for any installation related issues.
The heat Pump wasn't cooling efficiently like a 13 seer Heat Pump would. The Heat Pump had problems before the Labor warranty ran out in 07! There was a Service call in July, 3 service calls in August. There was one in September. And there was one in October. And the Last was in November.
Now to sum up the problems then would be: The Heat Pump compressor was shutting off for hours at a time. Then when the compressor was running the Heat Pump didnt even cool normally. For example every time the outside temp go to 90 degrees it would always get above 78 degrees in the house. So in end between all those service call this is what was done.
One was to clean the coils. That didnt do a thing.
One call was to find out why it wasnt cooling. Nothing found.
Another call was do the same thing. Freon was added. No results.
Another call was to again find the problem, Compressor turned out to be bad.
Another call compressor and dryer were replaced.
Another service call was made because even after the junked compressor was replaced the system still wasn't cooling normally.
The next call was made and they found out the TXV valve was bad.
The last call was for the Tech to Replace the Faulty TXV valve.
Now I will say is that Sears tech replaced a criticial component of the Heat Pump which was the TXV valve, so the tech was asked about checking to see if the Heat Pump would work the following spring and the tech said NO! HE said the Heat PUmp would have to be checked the following spring or summer.
So in 2008 the next year it didnt cool and Sears was called. So person said this and that but never called back. So that went on for the most of the year in 2008.
So I think they are responsible becuase there was no way for them to verify that the Heat Pump was fixed unless there was a Service call in 2008 which there wasnt. But they were called over and over again.
So Now the Heat Pump doesnt work at all. To further explain my response to the other guy would be that other Certified tech which was paid a $100 to diagnose the Heat Pump couple days ago was that the Unit was Junk.
He found that the Thermostat was bad. He also found that the circuit board was bad. He also stated that the Heat Pump wasn't cooling normally however he stated that his diagose of the Heat Pump showed that it was cooling except that is wasn't cooling enough.
It was cooling the air 13 degrees. He said it was atleast 18-20 degrees for my Unit and that he needed more time and that time was up.

They never fixed the Heat Pump even when it was under warranty and I could prove that by showing or proving that they replaced the TXV valve when it was 30 degrees outside and winter set in.
Why should I have to pay Labor charges when it was never fixed under warranty?

We faxed a Complaint against Sears to the BBB. So now its about waiting to see what their response is.

I'm not gonna suck it up because they never properly fixed it when it was under warranty. I even have messages on my answer machine from Sears Representatives in 2008 regarding the Heat Pump

Its too bad I didn't know this. If I knew they were gonna use cheap contractors to install this then I would have not used Sears. Now with that Said the Heat Pump was a Lemon which should have never left the factory.

Theres 1 full year warranty left on the entire Unit but 6 years left on the Lines and Compressore and coils. My Labor warranty ran out during Sears Service calls.

The heat pump is not a lemon, the type or manufacturer of a system is meaningless. I could install a 13 SEER R22 builder grade system or a 23 SEER IQ inverter technoligy system and they both would do the same thing only one would be cheaper to operate and would have a little better humidity removal.
Almost all problems stem from a poor installation, thats why its mind boggling for me to see everybody going on about what system is better then the other. The most important thing is the installing contractor as you have found out.
Your best bet is to contact a local factory authorized company and speak to there service manager, have them send out there lead tech and go after Sears later...Sorry:(

Thanks for posting all the issues. I don't think anyone could deny you have a serious customer service issue.
Any tech you have come in that declares you system junk is probably not the right person to get the job done. Assuming you eventually get the system working smoothly my biggest concern is whether it is undersized. Did you have a load calc (aka Manual J) done? You also need someone to check your install.
On the customer service side, you have done a good job documenting the issue, and you will need to continue. When a situation gets this serious I recommend folks keep a log of every conversation, and start climbing the management ladder. No conversation occurs without asking 'who is your boss, and what is his/her number'? If your situation is not resolved simply talk to the next person up the chain. Talk to Sears, Carrier, your state AG, the BBB and anyone else that can help.

A call to your local news channel that does investigations usually gets results. Here we have "12 on your side".
No one likes bad publicity and once something like this airs, results are generally pretty fast. I've even seen where some other company that had nothing to do with any of it, fix the problem just for the free positive publicity.

As you have now found out from the PRO sites you have visited you are realizing the value of a quality contractor and installaion. I really do empathise with you and feel that you did not in any way shape or form receive the product or service you payed for.
Having said that, agian, contact your local Carrier rep or Pierce Phelps, have them send a Tech rep out to your location get the problem fixed and take it to Sears and make them stand by there shear lack of HVAC
