I ahve these family of 3 living above me .They ahve a 1 year kid who runs, jums , drop things on the floor until about 10 PM.After that the perents take the role of being noisy. They move furniture, loud music etc so the whole apartment shakes. I talked to the perents 2 times and they said they would not do anything since their kid in 1 years old.
Yesterday i went up to their apt and to the lady, she came out, ignoring me and went down the stair to open the door for somebody who was coming over. She complained to the landloard about me saying taht I was following her and screaming at her. When we both got down I wanted to get out of the buildinf but she didn't let me.She blocked the door with her body.I had to raise my voice so she could hear me.
With all these said my landloard believes I am violating the rules by yelling at her and he is not going to do anything about the noisy kid. He said something like she can't obligate people to calm the kids down.This property is very large, I am dealing with landloard who should know the law.

Read your lease agreement to see if there is any mention of noise. There is usually a paragraph that may read as follows: "To see that the conduct of him/herself, family and guests are never disorderly or boisterous; that is does not disturb or interfere with the rights, comfort or convenience."
The lease agreement is between the lessor and the lessee. It the responsibility of the landlord (lessor) to enforce the terms of the agreement. It is not your responsibility.
Do not yell or scream at the neighbor. Direct all complaints to the landlord in writing and keep a copy for yourself. Keep a journal of events.
Learn your state's landlord/tenant laws which covers the rights and duties of both tenants and landlords. http://www.tenant.net/Other_Areas/Ohio/landlord.html
It clearly states that one of the tenant's duties is to not disturb neighbors.
One thing that helps somewhat is to create 'white noise' by keeping the TV or radio going to block out some of the external noise. It is within reason to hear folks moving about, TV/radio within reasonable volume, and footsteps overhead. That's part of being a renter and living in multi-family housing. When noise exceeds reasonable limits, then it becomes a problem.
