I purchased a home in Rockland County New York 2 years ago.
The was inspected 4/24/06 with no major problems reported

At the time of inspection 2 large areas of bamboo were growing within 3 feet of the rear of the house. I had no idea at the time the problems bamboo can cause. The home inspector made no comment on the bamboo.
2 years later and the bamboo is out of control – It is growing along the foundation wall of the home. It is starting to come up through the driveway. It is breaking into our detached garage.

Is the inspector liable in any way as they were to inspect the vegetation, grading, surface drainage, and retaining walls on the property?

You said yourself that there was no problem two years ago, yet you want the home inspector to take the blame. The home inspector's inspection is visual. He saw no problems either.

You say that you did not know that bamboo could cause problems. Yet, you expect the inspector to know that. He probably does not know bamboo from sugar cane.

The onus is on the homeowner to identify plant species in the landscape and potential problems associated with growing characteristics and properly maintain landscape plants.

Apparently, there was no problem several years ago when the visual inpsection was made. - Did the bamboo just grow in a spurt very recently without you noticing it?

The inspector has not control over how the property was maintained. Many people enjoy bamboo and are willing to control it in order to get the benefits.

In response to both replies

I have had the bamboo grove inspected by a professional.
The damage was not caused by lack of maintenance of the plant.

The damage was caused by the planting of an uncontained bamboo grove so close to the property. I would expect a professional and paid inspector to question the impact of such vegetation and at least question how it could adversely affect the building.

The onus to inspect the vegetation on the property is on the home inspector according to The American Society of Home Inspectors. I do expect the inspector to know the difference between Bamboo and Suger Cane, that’s why they are paid a professional.

If I had the level of knowledge of a home inspector I would not have hired a professional to carry out the home inspection.

I spoke to the home inspector today and she admitted she should have seen this problem.
