Has anyone had a faulty inspection done only to then find infestation after purchasing the property? I'm currently in this situation and was looking to see if anyone has experience with this and what I might be able to expect.

This was about a termite inspection, thought that would have been the best place to post it.

Termite inspectors can only inspect what they can see. They can not see inside wall voids or into areas that are not visible. They do not have x-ray vision. They can, however, inspect for visible signs of infestation and treat accordingly. That is why it is important to maintain the warranty. Termiticide treatments have a limited life. An inspector may inspect today and there be no signs of termites. Next month there may be termites tunneling. Addressing moisture issues around the structure tends to help keep termites and woodboring insects at bay.

I know this is an old posting but I was asking a question on another forum and I thought about the predicament my wife and I were in several years ago and I did a search to see if I could help someone else. So if you still want to hear what I have to say... Your question is a loaded one. In a word to your post question. Yes. I am not an home inspector, termite inspector or a lawyer but I am a homeowner who has learned quite a bit on this subject the hard way and I will give it to you straight. Was this a termite inspection or house inspection? When you say faulty inspection - please explain? Did he say there were no termites present? Were there signs of old infestation? Did they (the termite company) offer you a warranty? Could the inspector get to all areas of the house? Did you question the previous homeowner about anything you found suspicious in the walk through or anything that was unable to be seen by the inspector because of furniture, etc.? Are we talking subterranean termites? How did you find the termites? Was there new construction or signs of fresh paint where you found termites? This was at the end of October when you posted this...is this when you found the termites?

I was looking at this forum, because I bought a house a few months ago and just discovered serious termite damage on a main beam in the basement. I wasn't thinking about lawsuit at this point, but that's possible I might get to that, if the damage is extensive. That's why I would be very interested by your experience if it's similar to mine, 1manworking.
The reasons I might have grounds to sue the previous owner is that the basement seems to have been finished shortly before the sale and that new sheetrock was covering the damaged beam, which makes me think they might have tried to cover up the infestation. They also signed a disclosure stating they weren't aware of any infestation in the house.

If sheetrock covered the beam with infestation, the home inspector could not have seen it. The infestation could have occurred after the sheetrock was installed. The time and expense of the lawsuit would likely be better spent toward taking care of treatment and repairs.
