Recently bought a townhome built in 2004. Recent cold weather noticed a draft when windows shut and locked. Also glass is ice cold. look like double pane windows.
Are these cheap builder windows or something else wrong?

Likely your first guess, cheap windows. Builders grade windows may be double pane, which is better than single, but not much. And the weatherstripping is usually not up to par. I never understood why anyone was allowed to sell that crap. One other possibility, there is always an air gap between the window and framing, if they used cheap windows, they alos may have cut corners and not insulated that space. Pull the trim off one side and check, unless it is a drywall return, which it likely is.

Did you get a home warranty? Even builder grade windows come with a warranty. Brand? Is it possible to contact the builder? Seller?

Vinyl windows. Bottom slides up and down. Two latches in the middle locks. There is a thin fuzzy strip in the middle. Still lets cold air in. I bought the strip rubber insulation. Applied to outside just below fuzzy strip and it made a huge difference.
Don't know why the glass is cold.
I'll try to see if I can find any information on the windows. Model number or manufacturer.
Warranty expired after one year. Besides warranty says some air leakage is common and excluded from coverage.

Yes, some air leakage is allowed, but on quality windows, that is at a minimum. Do you use the latch at the window joint?? You should, it pulls the sashes together and makes a tighter seal.
