I have a tenant who is breaking her lease (nonpayment of rent and moving out). Can I file for possession and damages (lost rent) on the same complaint or are they separate issues? Does anyone know the procedures. I posted a notice as the first step. I live in Pa but I think the laws are somewhat similar in other states.
Thanks,
David

You hit it right on the head - every state is different. To start, I would call the county courthouse and talk to someone who works in small claims. If you have rental property, these are people you are going to get to know pretty well over the years.
Here in Wisconsin, we file only one claim that covers both the eviction and the damages.

I did find a couple of websites that showed the claim forms and layed out the procedure. It does allow for damages and possession. I'm hoping she leaves as she says she is, w/o it going the full time period before a sherriff can forcibly remove her. This way I will only have 1 month rent to collect and probably some cleaning fee.

Get her plate number, work etc etc etc if you don't already have it all. Can't go after her for damages if can't find her. take pics etc etc Send a certified letter to her not just post it on the door.
