2 1/2 year old AO Smith FCGL 40 gas hot water heater having minor leaks from top seams. No puddles on floor but drip stains on outside of tank at various locations but all start at the top seam and go down, fresh water today. Does this mean it needs to be replaced already??

Inspect your connecting hoses for leaks and make sure your vent cap is in place on the roof. Usually when water heaters leak they continue to leak and become very noticeable. If it is leaking your tank should still be covered under warranty but not the labor to install it.
