The U.S. Uniform Building Code says min. 34" and max. 38". In Canada, it's probably the same, except perhaps in metric units. Call your local building department.

Like Razz says, 34" to 38". That is measured from the nose of the tread. And it has to be uniform. If you use 34" at the top, you have to use it at the bottom too. The railing has to be parallel with the stairs.
