is it ok to shim a stud at the top, where it connects to the top plate? ive already nailed into my bottom plate, and some of the studs dont reach the top now, because as i went along, a slightly tighter fitting stud pushed the top plate up just a bit.

I'd go back & pull the long stud out & trim it to match the rest. Don't like the idea of shims between the studs & the plate. I know that's not what you wanted to hear sorry. ;)

would it be a code violation to do this?

also, whats the problem with shimming at the top, they might come loose in the future?

this is for a non load bearing wall, and the gap between the shorter studs and top plate is almost paper thin.
